Welcome to Fête Society! These Terms and Conditions govern your use of our website fetesociety.com and the purchase of our custom products and services. By accessing our website or placing an order, you agree to be bound by these Terms and Conditions. Please read them carefully before making a purchase.
1. General Information
Fête Society is a custom e-commerce business specializing in made-to-order products, digital designs, and other creative services. We are based in St. Louis, Missouri, USA, and serve customers throughout the United States.
By accessing our website, placing an order, completing checkout (including checking any acknowledgment boxes), and submitting payment, you agree to be bound by these Terms and Conditions. In the absence of a separate signed contract, your checkout acknowledgment and payment constitute binding electronic acceptance of all terms herein.
2. Custom Orders and Production
2.1 Nature of Products
All products offered by Fête Society are custom-made and tailored specifically to each client's requirements. Each item is unique and produced based on your specifications, design preferences, and approved proofs.
2.2 Lead Times and Project Timelines
-
Production timelines are clearly stated on each product page and in your order confirmation.
-
The timeline provided in your quote serves as the official project timeline that must be followed to ensure timely delivery for your event.
-
It is the customer's responsibility to review and note the lead time for each item before placing an order. If a lead time is not listed please enquire to ensure your product is on track to arrive on time.
-
Customers must respond to proofs, requests for information, and communications within the specified timeframes to maintain the project schedule.
-
Failure to adhere to the project timeline may result in delayed delivery, and Fête Society will not be held responsible for items that do not arrive in time due to customer delays in approvals or communication.
2.3 Design and Sourcing Fees
Fête Society charges separate fees for design services and product sourcing. These fees are non-refundable as they represent time, expertise, and resources invested in your custom project.
3. Order Approval and Customer Responsibility
3.1 Proof Approval
-
Prior to production, customers will receive digital proofs of their custom designs.
-
Once a customer approves a final proof, the customer assumes full responsibility for the accuracy of all information contained within the design.
-
This includes, but is not limited to: spelling, grammar, dates, times, venue information, names, and design elements.
-
Fête Society is not responsible for errors in approved proofs and will not provide refunds or complimentary replacements for customer-approved mistakes.
3.2 Review Obligations
Customers are strongly encouraged to:
-
Carefully review all proofs multiple times before approval
-
Have another person review proofs for accuracy
-
Verify all dates, times, names, and event details
-
Check spelling and grammar thoroughly
3.3 Changes After Approval
Once a proof is approved and production has begun, changes cannot be accommodated. Any requests for modifications after approval may require a new order at full price.
4. Pricing and Payment
4.1 Pricing
All prices are listed in US Dollars (USD) and are subject to change without notice. The price charged will be the price displayed at the time of order placement.
4.2 Payment
-
Payment is required at the time of order unless other arrangements have been agreed upon in writing.
-
We accept payment methods as indicated on our website through our Shopify payment processing system.
-
By providing payment information, you represent that you are authorized to use the payment method provided.
4.3 Taxes
Applicable sales taxes will be added to orders as required by law based on the shipping destination.
4.4 Agreement to Terms
By completing the checkout process, including checking the acknowledgment box and submitting payment for design fees, sourcing fees, or product purchases, you are entering into a binding agreement with Fête Society and explicitly agreeing to these Terms and Conditions.
In cases where a separate formal contract has not been executed, your acknowledgment at checkout and payment submission constitute your electronic signature and full acceptance of all terms, policies, and conditions set forth herein, including but not limited to our custom order policies, proof approval requirements, refund limitations, and timeline responsibilities.
This electronic acceptance is legally binding and equivalent to a physically signed agreement.
5. Returns, Refunds, and Cancellations
Please refer to our complete Return and Refund Policy for detailed information. Key points include:
5.1 Final Sale Policy
All custom-made orders are final sale and non-refundable. Due to the personalized nature of our products, we cannot accept returns or offer refunds except in cases of defects or errors caused by Fête Society.
5.2 Defective or Damaged Items
If your order arrives damaged or contains errors caused by Fête Society (not customer-approved errors), please contact us within 3 business days of delivery. We will offer a replacement or store credit as appropriate.
5.3 Cancellations
Custom orders cannot be canceled once production has begun. Design and sourcing fees are non-refundable regardless of when cancellation is requested.
5.4 Event Timing
Fête Society is not responsible if items do not arrive in time for your event. Please order well in advance and account for production and shipping times. No refunds will be issued for timing issues.
6. Shipping and Delivery
6.1 Shipping
Shipping costs are calculated at checkout based on the destination and selected shipping method.
Production timelines do not include shipping time. Please review total estimated delivery times before ordering.
Many of our custom products are produced overseas through trusted manufacturing partners. We recommend allowing a minimum of eight (8) weeks for combined production and transit time for all internationally produced items.
In most cases, international shipments are first sent to Fête Society, where we verify quantities, inspect quality, and repackage each order before forwarding it to the final client. This process ensures that each product meets our standards prior to delivery.
The shipping rate displayed at checkout applies only once your order ships from Fête Society, unless otherwise specified. If your order ships directly from an international vendor, this will be clearly noted as “International Shipping” at checkout, along with a specific rate for that service.
6.2 Carrier Responsibility
Once items leave Fête Society’s facility or that of our manufacturing partners, they are in the care of the shipping carrier. Fête Society is not responsible or liable for any delays, customs inspections, damages, or losses occurring during transit.
6.3 Address Accuracy
Customers are responsible for providing accurate shipping addresses. Fête Society is not responsible for orders shipped to incorrect addresses provided by the customer.
6.4 Undeliverable Packages
If a package is returned as undeliverable due to customer error, the customer will be responsible for any reshipping costs.
7. Intellectual Property
7.1 Ownership
All designs, graphics, logos, and content created by Fête Society remain the intellectual property of Fête Society unless otherwise agreed upon in writing.
7.2 Usage Rights
Customers receive a license to use purchased designs for their personal event or specified purpose. Customers may not resell, redistribute, or use designs for commercial purposes without express written permission.
7.3 Customer-Provided Content
If you provide images, logos, text, or other content for use in your custom order, you represent that you have the right to use such content and grant Fête Society permission to incorporate it into your order.
